These terms apply whenever you engage JOF Agency ("we", "us") for social media strategy, creative direction, or web presence & management services. By instructing us or accepting a proposal, you agree to the terms below. For Web Presence & Management clients, these terms apply together with your signed Client Service Agreement and its attached Schedule A (Website Package – Scope of Work). Where there is any conflict between this page and your signed Agreement, the signed Agreement takes priority.

Our Services

We provide social media strategy, content and creative direction, and website design, hosting and management. For Web Presence & Management, the specific deliverables included in your plan are set out in Schedule A of your Client Service Agreement, not on this page. General descriptions of our services on this site are for marketing purposes only and do not vary your signed Agreement.

Fees & Payment

• The website itself is provided free of charge, with no one-off setup fee. Web Presence plans instead involve an ongoing monthly management fee, covering Local SEO Optimisation, Automated Live Chat and Automated Lead Recovery, which has a minimum term of 3 calendar months from your Agreement date, after which it continues on a rolling monthly basis.
• The monthly management fee is collected by Direct Debit via GoCardless. Any separately approved change request fee (for example, an additional website section) is payable via Stripe before that work begins.
• Late or failed payments may result in a temporary pause of services, including taking a website offline, until payment is resolved.

Cancellation

The monthly management fee cannot be cancelled during the 3-month minimum term referred to above, except where required by law or where we terminate for your breach of these terms. After the minimum term has ended, either party may cancel the ongoing monthly service by giving 30 days' written notice by email. If you cancel, or we terminate for your breach (including non-payment), before the end of the minimum term, you remain liable for the monthly fees that would otherwise have fallen due for the remainder of that term, which become payable immediately. Any approved change request fee is a separate, non-recurring charge and is non-refundable once work has commenced, except where required by law.

Scope, Revisions & Change Requests

Your Web Presence plan includes a fixed number of website sections, Local SEO Optimisation, an automated Live Chat, Automated Lead Recovery, two rounds of revisions before launch, and a monthly allowance of standard and urgent content update requests, all as set out in Schedule A of your Client Service Agreement. Any request beyond this scope is treated as a change request and is quoted and charged separately. We do not begin change request work without your written approval of the fee.

Websites, Domains & Hosting

Websites built under a Web Presence plan remain live only while your subscription is active. Domain names remain registered to whichever party purchased them; where JOF Agency manages a domain on your behalf, ownership details will be confirmed in writing. We use third-party providers, including Netlify, for hosting, and cannot guarantee 100% uptime.

Content & Client Responsibility

You are responsible for the accuracy and legality of any content, images or information you supply to us, and for ensuring you have the right to use it. We reserve the right to decline content that is unlawful, defamatory, or infringes third-party rights. Photography and imagery for your website are supplied by you; we do not shoot, source, or licence photography or stock images as part of a standard Web Presence plan.

Intellectual Property

As no one-off setup fee applies, your own content and brand assets used on your website remain your property throughout. JOF Agency retains ownership of its own pre-existing design system, including templates, layout structures, reusable components and code, whether or not they are used on your website; you receive a licence to use these as part of your live website for as long as your Agreement continues, and JOF Agency remains free to use, adapt and licence the same underlying design system to other clients.

Liability

We aim to deliver services with reasonable care and skill, but we do not guarantee specific business, sales or growth outcomes, including any particular search ranking, visibility, or volume of enquiries from Local SEO Optimisation. To the extent permitted by law, our liability for any claim is limited to the fees paid by you for the relevant service in the preceding 3 months.

Changes to These Terms

We may update these terms from time to time; the current version will always be available on this page.

Governing Law

These terms are governed by the laws of England and Wales.

This policy explains what information JOF Agency collects through this website, why, and how it's handled.

What We Collect

When you submit our contact form, we collect the details you provide: your name, email address, business name, phone number (if given) and your message, along with which service plan you selected (if any).

How We Use It

• To respond to your enquiry and discuss the services you've asked about.
• To set up and manage your account if you become a client, including billing via Stripe and GoCardless.
• To send you service updates relevant to work we're carrying out for you.

We do not sell or share your personal data with third parties for marketing purposes.

Where Your Data Is Stored

Form submissions are processed and stored by Netlify, our hosting provider, acting as a data processor on our behalf. Payment details are handled directly by Stripe and GoCardless; we do not store your card or bank details ourselves.

Cookies

This site does not currently use tracking or advertising cookies. Only essential technical data needed to serve the website is processed by our hosting provider.

How Long We Keep It

Enquiry data is kept for as long as reasonably needed to respond to you or, if you become a client, for the duration of our working relationship plus a reasonable period afterwards for accounting and legal purposes.

Your Rights

Under UK GDPR, you have the right to access, correct, or request deletion of your personal data, and to object to or restrict certain processing. To exercise any of these rights, email support@jof.agency.

Changes to This Policy

We may update this policy occasionally; the current version will always be available on this page.

Existing clients can reach us any time at support@jof.agency. We aim to acknowledge messages within 24 hours, Monday to Friday. Acknowledging your message is not the same as completing a request; completion times are set out below and in your Client Service Agreement.

Standard Website Updates

Your plan includes two (2) standard requests per calendar month — minor text or image updates to existing approved content, such as opening hours, contact details, a single photo, a testimonial, or a short paragraph of text. Standard requests are completed within 5 working days.

Urgent Website Updates

Your plan also includes two (2) urgent requests per calendar month, completed within 1 working day. Urgent requests are limited to minor, text-only, factual updates tied to a specific date or event (for example, updated holiday opening hours). They do not include image changes or new design work.

Requests Beyond Your Monthly Allowance

Once both allowances are used, further minor text or image requests that month are charged at a flat fee of £25 per request, agreed in writing before we start. Allowances do not roll over to the following month.

Live Chat & Automated Lead Recovery

Your plan includes Live Chat and Automated Lead Recovery, as described in your Client Service Agreement. If you need to update the business information Live Chat answers from, or update your Automated Lead Recovery, email us — this counts as one of your standard requests for the month.

Technical Issues

If your website, Live Chat, or Automated Lead Recovery appears to be down or not working correctly, email us straight away with a description of the issue (and a screenshot if possible) and we'll investigate as a priority.

Billing Questions

For any billing questions, including your monthly subscription or a failed payment, email us and we'll sort it out directly, there's no need to contact Stripe or GoCardless yourself.

What's Not Included

An additional website section (£150 per section), a full redesign, new images, custom animation, a CMS, e-commerce, third-party integrations other than Live Chat and Automated Lead Recovery, or revisions beyond the two rounds included before launch, aren't covered under your monthly allowance, but we're always happy to quote for extra work.
